Terms of Service

1. The agreement

These terms are between you and DKYS LLC ("we"), which runs Fitted at www.thefitted.online. By creating an account or using Fitted you agree to them and to the Privacy Policy. If you don't agree, don't use Fitted.

2. Who can use Fitted

You must be at least 16 and able to make this agreement. Accounts are opened from the waitlist; we may decline or delay an invitation. One account per person, and you are responsible for what happens under yours.

3. What Fitted does

Fitted helps you find job postings, scores them against your profile, rewrites your resume for each one from your own experience, keeps track of each application, and gives you a public page where people can book time with you. Fitted never submits an application for you: you decide what to send and you press Submit yourself.

4. The browser extension

The Fitted extension fills application forms in your browser at your request and never submits them. You are responsible for checking every field before you submit, and for using it only on your own applications.

5. Community and recruiters

Being listed in the directory, offering referrals and answering introductions are your choices; you can stop any of them at any time.

If you use Fitted as a recruiter, you must be employed by or recruiting for the company you were verified for, contact members only about real roles, respect a decline or a block, and never copy the directory or use it to build lists. The Recruiter plan is billed monthly after its free trial and can be cancelled any time. We may suspend a recruiter account that members block or report, or that breaks these terms.

6. Your content

You keep everything you put into Fitted — resumes, profile, answers, notes and your page. You give us permission to store and process it only to provide Fitted to you, including sending parts of it to the AI provider named in the Privacy Policy.

You are responsible for your content being true and yours to use. Fitted only rewords and reorders what is in your profile and refuses lines it can't trace back to it, but you must read every resume before you use it. An application is yours, and so is its accuracy.

7. Acceptable use

Don't use Fitted to:

• apply for jobs on someone else's behalf, or put someone else's information in it without their permission;
• submit false or misleading information to an employer;
• scrape or automate sites through Fitted in breach of their terms;
• get around your plan's limits, probe or overload the service, or try to reach other people's data;
• copy, resell or reverse engineer Fitted.

Employers' sites and job boards have their own terms, which apply when you use them.

8. Plans and payment

Fitted has a free plan and a paid Pro plan (currently $19 a month). Each plan's limits are shown on the pricing page and your account page. Pro is billed monthly in advance through our payment provider and renews until you cancel. Cancel any time; Pro continues until the end of the period you paid for and isn't refunded for part of a month, except where the law requires.

If we change a price, we'll tell you at least 30 days ahead, and the change applies from your next billing period.

9. AI output

Scores, tailored resumes and suggestions are produced with AI and can be wrong. They are aids to your judgment, not advice. Fitted doesn't promise interviews, offers or any result from an application.

10. Your public page and bookings

You choose what your page shows and you are responsible for it. People who book time with you give their details to you; treat them with care. We may remove a page that breaks these terms.

11. Ending

You can delete your account at any time from your account page. We may suspend or close an account that breaks these terms or puts the service or others at risk, and will tell you why unless the law or safety prevents it. We may change or stop parts of Fitted; if we stop the whole service we'll give you notice and time to export your data.

12. Disclaimers

Fitted is provided as it is and as available. To the fullest extent the law allows, we disclaim all warranties, including of fitness for a particular purpose, and don't guarantee it will be uninterrupted or error-free.

13. Limits on liability

To the fullest extent the law allows, we aren't liable for indirect, incidental, special or consequential losses, or for lost opportunities, income or data, and our total liability for any claim about Fitted is limited to the greater of US$100 and what you paid us in the 12 months before the claim. Nothing here limits liability that can't be limited by law.

14. Indemnity

If someone makes a claim against us because of content you put into Fitted or your breach of these terms, you'll cover our reasonable costs of it, to the extent the law allows.

15. Law and disputes

These terms are governed by the laws of the State of Washington, United States, without regard to its conflict-of-law rules. Disputes go to the state or federal courts in King County, Washington, unless the law where you live gives you the right to bring them where you are.

16. Changes

We may update these terms. If a change matters, we'll tell you by email or in Fitted before it takes effect; continuing to use Fitted after that means you accept it.
